Terms and Conditions on the Use of this Website

Introduction

The Website (hereinafter referred to as the „Website”) is operated by IndHex Hidrogén Kft. (company registration number: 01-09-424178; registered office: 1141 Budapest, Szugló utca 82, Hungary; hereinafter referred to as “IndHex” or the “Company”). These terms and conditions (hereinafter referred to as “Terms and Conditions”) govern the use of the Website. By using the Website, you (hereinafter referred to as the „User”) accept these Terms and Conditions in full.

License to use the Website

Unless otherwise stated, IndHex is the owner of all intellectual property rights related to the Website, in particular but not limited to all content on the Website, its compilation, design and underlying database. Subject to the license below, all these intellectual property rights are reserved.

The User may view, download for caching purposes only, and print pages from the Website for the user’s own personal use, subject to the restrictions set out below and elsewhere in these Terms and Conditions.

Without a previous written consent of IndHex, the User may not:

  • republish material from the Website (including republication on another Website);
  • sell, rent or sub-license material from the Website;
  • reproduce, duplicate, copy or otherwise exploit material on the Website for a commercial purpose;
  • edit or otherwise modify any material on the Website;
  • redistribute material from the Website (except for content specifically and expressly made available for redistribution); and
  • reference any information on the Website unless IndHex has given its prior consent and IndHex name and Website address are included in the reference explicitly.

Acceptable use

The User must not use the Website in any way that causes, or may cause, damage to the Company, its image or to the Website or which may cause an impairment of the availability or accessibility of the Website; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

The User must not use the Website to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software.

The User must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to the Website without prior written consent of IndHex.

The User must not use the Website to transmit or send unsolicited commercial communications.

The User must not use the Website for any purposes related to marketing without IndHex express written consent.

Restricted access

IndHex reserves the right to restrict access to areas of the Website, or indeed this entire Website, at IndHex discretion.

If IndHex provides the User with a User ID and password to enable the User to access restricted areas of the Website or other content or services, the User must ensure that the User ID and password are kept confidential.

IndHex may disable the User’s User ID and password in IndHex sole discretion without notice or explanation.

User content

In these terms and conditions, "user content" means material (including without limitation text, images, audio material, video material and audio-visual material) that the User voluntarily submit to the Website, for whatever purpose. This license grants IndHex the fullest license permitted by applicable law.

The User grants IndHex a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate and distribute its user content in any existing or future media. The User also grant to IndHex the right to sub-license these rights, and the right to bring an action for infringement of these rights.

The user content must not be illegal or unlawful, must not infringe any third party's legal rights, and must not be capable of giving rise to legal action whether against the User or IndHex or a third party (in each case under any applicable law).

The User must not submit any user content to the Website that is or has ever been the subject of any threatened or actual legal proceedings or other similar complaint.

IndHex reserves the right to edit or remove any material submitted to the Website, or stored on IndHex servers, or hosted or published upon the Website.

No warranties

The Website is provided "as is" without any representations or warranties, express or implied. IndHex makes no representations or warranties in relation to the Website, or the information and materials provided on the Website.

Without prejudice to the generality of the foregoing paragraph, IndHex does not warrant that:

  • the Website will be constantly available, or available at all; or
  • the information on the Website is complete, true, accurate or non-misleading.

Nothing on the Website constitutes, or is meant to constitute, advice of any kind.

Limitations of liability

IndHex will not be liable to the User in relation to the contents of, or use of, or otherwise in connection with, the Website:

  • to the extent that the Website is provided free-of-charge, for any direct loss;
  • for any indirect, special or consequential loss; or
  • for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data.

These limitations of liability apply even if IndHex has been expressly advised of the potential loss.

Reasonableness

By using the Website, the User agrees that the limitations of liability set out in the Website disclaimer are reasonable.

If the User does not think they are reasonable, the User must not use the Website.

Other parties

The User accepts that, as a limited liability entity, IndHex has an interest in limiting the personal liability of its officers and employees. The User agrees that the User will not bring any claim personally against IndHex officers or employees in respect of any losses the User suffers in connection with the Website. This is an express waiver of rights.

Without prejudice to the foregoing paragraph, the User agrees that the limitations of warranties and liability set out in the Website disclaimer will protect IndHex officers, employees, agents, subsidiaries, successors, assigns and sub-contractors as well as IndHex.

Unenforceable provisions

If any provision of the Terms and Conditions is, or is found to be, unenforceable under applicable law, that will not affect the enforceability of the other provisions of the Terms and Conditions.

Indemnity

The User hereby indemnifies IndHex and undertake to keep IndHex indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by IndHex to a third party in settlement of a claim or dispute on the advice of IndHex legal advisers) incurred or suffered by IndHex arising out of any breach by the User of any provision of these Terms and Conditions, or arising out of any claim that the User has breached any provision of these Terms and Conditions.

Breaches of these Terms and Conditions

Without prejudice to IndHex other rights under these Terms and Conditions, if the User breaches these Terms and Conditions in any way, IndHex may take such action as IndHex deems appropriate to deal with the breach, including suspending the user’s access to the Website, prohibiting the User from accessing the Website, blocking computers using the user’s IP address from accessing the Website, contacting the user’s internet service provider to request that they block the user’s access to the Website and/or bringing court proceedings against you.

Variation

IndHex may revise these Terms and Conditions. Revised Terms and Conditions will apply to the use of the Website from the date of the publication of the revised Terms and Conditions on the Website. It is the sole responsibility of the User to regularly check this page to ensure that the User is familiar with the latest version of the Terms and Conditions.

Assignment

IndHex may transfer, sub-contract or otherwise deal with IndHex rights and/or obligations under these Terms and Conditions without notifying the User or obtaining the User’s consent.

The User may not transfer, sub-contract or otherwise deal with the User’s rights and/or obligations under these Terms and Conditions.

Severability

If a provision of these Terms and Conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

Entire agreement

These Terms and Conditions constitute the entire agreement between the User and IndHex in relation to the User’s use of the Website, and supersede all previous agreements in respect of the User’s use of the Website.
